Shepard Fairey Pleads Guilty in AP Criminal Case

Although Shepard Fairey’s civil case with the Associated Press over the “Obama Hope” image has been settled in 2011, there’s still the criminal case.  Shepard has pleaded guilty to one count of criminal contempt for destroying documents, manufacturing evidence and other misconduct in his case involving his “Hope” poster of Barack Obama.  If convicted, he faces a maximum sentence of six months in prison, a $5000 fine and a maximum term of supervised release of one year.

Great news for the art world!  A judge has dismissed copyright lawsuits between Shepard Fairey, who created the Barack Obama “HOPE” image and The Associated Press but has left a March trial date in place for related claims between the news service and companies that sold merchandise using the artist’s image.  You can read more about this exciting ruling here.  I also agree with The Worley Gig’s commentary that “there are ways to amicably resolve these types of issues without getting all Metallica-style litigious on everyone’s ass. At any rate, the ruling is good news for Fairey, whose work I am a huge fan of , and other artists of his ilk, who sometimes appropriate fair use images from pop culture in their artwork.”  You can read The Worley Gig’s comments about the ruling here.

The Associated Press is suing artist Shepard Fairey for unauthorized usage of a photo of US President Barack Obama, which Fairey turned into an iconic art piece called “Hope.”  Those who are lovers of art know that images are borrowed, improved upon or enhanced all the time and it’s really no big deal.  The AP obviously feels this is a big deal and they have not dropped their ridiculous suit.  To make matters even more sickening, the AP, in a gross conflict of interest, has leaked a story saying “Judges are urging Shepard Fairey to settle out of court.”  Their story has spread across the internet quicker than a government created virus and lovers of art and freedom worldwide, including myself, are outraged!  All I can say is turn off the news and turn on your mind!
